Property Sale

  • Obtaining the Title Deeds and Documents;
  • Arranging for you to complete the Property Information Forms and Fittings and Contents Schedule;
  • Preparing the draft Contract and supporting documentation for approval by your Purchaser’s Solicitors;
  • Obtaining any further relevant documentation from you and seeking your instructions in relation to any additional enquiries raised by your Purchaser’s solicitors;
  • Liaising with you, your Purchaser’s Solicitors and any Lender;
  • When everyone is ready and a completion date has been agreed; attending on you in order to obtain your signature to the legal documentation required in readiness for Exchange of Contracts and Legal Completion.
  • Preparing a Completion Statement, setting out the financial transactions involved and any balance required from you should there be negative equity in the property,
  • Obtaining your authorisation to exchange Contracts, which is the stage when the transaction becomes binding and you are committed to the sale and the completion date is fixed.

Please note, the completion date is not legally binding until Contracts have been exchanged and either party may withdraw from the transaction up until exchange has taken place.

Accordingly, if you incur any expenses, prior to exchange of Contracts, i.e. removal company costs, alternative accommodation costs etc., you do so at your risk and are unlikely to be able to recoup any wasted costs from your seller/purchaser.

  • Making the pre-completion legal arrangements and checks, including obtaining your signature to the Transfer document, obtaining a Redemption Statement from your current Lender (if appropriate), preparing a Completion Statement, setting out the financial transactions involved, and preparing for the agreed completion date as specified in the Contract.
  • Completing your Sale on the agreed date, discharging any Mortgage secured against the property (if appropriate), paying any Estate Agents’ fees on your behalf, accounting to you for any net sale proceeds and forwarding the Transfer and any other relevant Title Deeds and documents to your purchaser’s Solicitors.
